The system can change, but this is how it will be in the beginning at least.
If you have 100 snooping noone will notice that you are snooping, it's when you steal you have a change to get caught and turn criminal. How big chance, how people know you have stolen items etc. is up to you to find out

Why would I care? I'm dead and I lose the items anyway. if its to someone else or to you..
Then in my eyes it would look more realistic if the items stay on the person who died with the stolen items. How can items just magically fly back to its owner? Besides everyone is able to loot it, so you can do as well if you were the previous owner.
If it gets changed that the items stay on the corpse. It would be fair to make anyone criminal who loots it (except for the owner of the items).
One question. When I've banked the items I've stolen. And then I take them back in my backpack. Do they still return to their owner when I die?

It doesn't magically return, when the guard comes to smite the thief they return the item silly.

What a lame argument.
Other wepon dont have damage based on wich creature its hiting so it dont afect them.
It same as say the +25 vanq bard did 100 on an undead creature before silver wepons added and now he do 75.
What is a lie, since you dont changed normal wepons to do less damag on undead, they hit the same as before.
What you changed is that now silver wepons do 25%+ on undead based on what it did if was a normal wepon (N: 100 , S:125), and 25%- on other creatures based on what it did if was a normal wepon (N:100 S:75).
So the normal wepon damg stay the same for undead or not.
